These Terms & Conditions ("Agreement") govern the use of existing and new products and services provided by Digital Solutions Aruba ("Company"). By engaging in the services of the Company, you ("Client") agree to the following terms:

1. Limitation of Liability

1.1 The Company provides digital products and services, including but not limited to software development, media production, IT support, and related services. The Client acknowledges and agrees that the Company shall not be held liable for any direct, indirect, incidental, or consequential damages arising from:

  • Loss, corruption, or theft of data,
  • Unauthorized access, hacking, or security breaches,
  • Cyber attacks, malware, or any other malicious activity affecting the Client's data, systems, or software.

1.2 The Company disclaims all liability for any such incidents, regardless of when they occur, including after the delivery of the service.

2. Client Responsibility

2.1 The Client is responsible for implementing and maintaining adequate protections to safeguard their data and systems. This includes but is not limited to:

  • Regular data backups,
  • The implementation of security protocols and firewalls,
  • Keeping software and hardware up to date,
  • Adopting industry-standard cyber hygiene practices.

2.2 While the Company may provide advice or assistance in improving security measures, it is the Client's sole responsibility to ensure the protection of their systems.

3. Content Liability

3.1 The Client acknowledges that the Company is not responsible, nor liable, for any content used in the services provided. This includes but is not limited to:

  • Text, images, graphics, videos, or other digital assets used in web development and web design services,
  • Any third-party materials, copyrighted content, or assets provided by the Client or used at the Client’s request.

3.2 Unless explicitly and specifically agreed upon in writing, the Client is solely responsible for ensuring that all content used in connection with the Company’s services complies with applicable laws, regulations, and intellectual property rights.

3.3 The Client agrees to indemnify and hold harmless the Company from any claims, damages, or legal actions arising from the content used in the Client's projects, including but not limited to claims related to copyright infringement, defamation, or violation of intellectual property rights.

4. No Guarantee of Error-Free or Uninterrupted Service

4.1 The Company strives to deliver reliable and secure services. However, the Company does not guarantee that the provided products or services will be free from vulnerabilities or immune to external threats.

4.2 The Client acknowledges that the Company is not liable for any service disruptions, data loss, or security breaches, and agrees that such events will not give rise to any claims for damages or losses.

5. Indemnity

5.1 The Client agrees to indemnify, defend, and hold harmless the Company, its employees, contractors, and affiliates from any claims, damages, liabilities, or expenses arising from the Client's failure to protect their own data, systems, or networks.

5.2 This includes but is not limited to any incidents involving unauthorized access, data loss, or security breaches, regardless of the involvement of the Company's services.

6. Acceptance of Terms

6.1 By using the Company's products and services, the Client acknowledges that they have read, understood, and agreed to be bound by these Terms & Conditions.

6.2 If the Client does not agree with these Terms & Conditions, they must refrain from using the Company's services.
